Terms and Conditions Advertisers:
Acceptance of Terms and Conditions 1.1 This advertisers agreement ("the Agreement") is made between Usellhomes ("usellhomes.co.uk", "We", "Us", "Our", "Ours") and the Advertiser ("You", "Your"). 1.2 By entering into this agreement you are confirming you have read these Terms and Conditions and agree to them. 1.3 You agree to us publishing your advert details on our web site and the web sites of our partners.
Your Responsibilities 2.1 You have the legal right to sell the property. 2.2 The description you supply is true and accurate and not misleading. The property description should only provide a factual breakdown of the property features and should not include claims about the property or terms of sale which are not a matter of fact or which cannot be ascertained and verified by reasonable inspection, or in the case of any legal aspects, confirmed by available documentation. We do not take any responsibility for the accuracy of the information supplied and cannot be held liable. 2.3 You will pay the full advert fee before the advert will be published. 2.4 You have obtained permission from the owner of any photographs used in the advert. You cannot use photographs from estate agent's particulars without their express permission. Usellhomes cannot be held responsible for breach of copyright. You agree to indemnify Usellhomes in respect of any claims against us or expenses incurred by us in respect of breach of copyright issues. 2.5 If you have a contract with an estate agent, you have independently checked your contract with regards to the terms and conditions that you must pay the estate agent's commission. If later it is found that you are legally bound to pay the estate agent's commission, Usellhomes will not be liable. 2.6 Only one property may appear in each advert. Individual property adverts are NOT transferable and may not be used for advertising of more than one property or any property other than the property advertised for sale initially without the explicit permission of Usellhomes. 2.7 You will erect the "For Sale" board complying with the local planning authority regulations.2.8. Sale boards remain the property of usellhomes at all times and must be returned to us on completion of sale 2.9 You will set your own selling price. 2.10 You will arrange and conduct viewings for the advertised property. 2.11 You will inform us once the advertised property is sold.
Our Responsibilities 3.1 We will supply a For Sale / To Let board with fixings, where requested, within 15 working days . Once the property has been sold Usellhomes must be contacted in order to return sale boards.If the board proves to be faulty a replacement will be offered free of charge. 3.2 Advertised properties will be reviewed after a period of 6 / 12 months (Depending on the package purchased) has passed from the date the advert was published. After which we will have the right to discontinue the advert. 3.3 We will, to the best of our efforts, ensure that our web site is available at all times. We reserve the right to take the site "off-line" without prior notice for essential maintenance and upgrades. We do not offer any guaranteed percentage time of availability and accept no financial liability for any interruption in service or temporary loss of some or all facilities at any time. 3.4 Any dispute to the provision of our service is subject to the laws of Scotland.3.5 We do not guarantee the work carried out by any of the third party advertisers and will not be accountable for any dispute that may arise in respect of same.
Refunds 4.1 No refund can be given for the cost of the actual advertisement once live, however we may issue refunds at our discretion. Limit of Liability 5.1 Under no circumstances will our liability exceed the value of the advertising fee received.
Users: Acceptance of Terms and Conditions 1.1 This users agreement ("the Agreement") is made between Usellhomes ("usellhomes.co.uk", "We", "Us", "Our", "Ours") and the User ("You", "Your"). Accuracy of Information 2.1 In no event or circumstance shall we be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence, arising out of or in connection with the use or performance of this information. 2.2 It is your responsibility to verify any information that you may obtain from our website with independent authorities before acting upon it. Limit of Liability 3.1 We will not be liable for any computer virus transmitted through our website. It is your responsibility to use suitable anti-virus software on any material that you may download from usellhomes.co.uk. 3.2 We will not be liable for negligence, breach of contract, misrepresentation or otherwise, for any direct or indirect consequential damage suffered by you as a result of your use of our website. Copying 4.1 You may print hard copies of any material for your own personal non-commercial use. All other forms of copying are prohibited.
Placing an advertisement: By submitting your property advertisement to Usellhomes.co.uk you are instructing us to publish your property details on Usellhomes.co.uk. All property advertisements are accepted in good faith and that they are private sales / private lets only. The property information supplied by you must be honest and accurate. Whilst we strive to provide a reliable and error free service it is imperative that the user should without delay amend any errors contained in your advertisement.
